Please read these terms carefully before placing an order. By using our website and services, you agree to be bound by these terms.

1. General

These General Terms and Conditions ("Terms") apply to all offers, agreements, and deliveries by APEX Wear, registered at the Dutch Chamber of Commerce (KVK) under number 83950575, with its principal place of business in Amstelveen, the Netherlands ("APEX", "we", "us").

By placing an order through our website at apex-wear.com or through any other sales channel, you ("Customer", "you") agree to these Terms.

APEX reserves the right to modify these Terms at any time. The version applicable to your order is the version in effect at the time the order was placed.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

2. Offers & Prices

All offers on our website are without obligation and valid while stocks last, unless stated otherwise. We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time of placing the order.

All prices displayed on our website are in euros (€) and include Dutch VAT (BTW) at the applicable rate, unless stated otherwise.

Shipping costs are not included in the product price and will be calculated and displayed separately at checkout. For current shipping rates, please refer to our Shipping & Returns page.

Obvious errors or mistakes in pricing do not bind APEX. In the event of a pricing error, APEX will notify you and offer the option to proceed at the correct price or cancel the order.

3. Orders & Agreement

An agreement between you and APEX is established at the moment you place an order through our website and receive an order confirmation by email. This confirmation constitutes acceptance of your order.

APEX reserves the right to refuse or cancel orders at its discretion, including but not limited to cases of suspected fraud, incomplete or incorrect information, or unavailability of products.

You are responsible for providing accurate and complete delivery and contact information. APEX is not liable for delays or non-delivery resulting from incorrect information provided by you.

4. Payment

Payment is due at the time of placing the order. We accept the following payment methods: iDEAL, PayPal, Klarna, credit/debit cards (Visa, Mastercard, American Express), Apple Pay, and Google Pay.

All payments are processed securely through our payment service provider. APEX does not store your payment details.

If payment is not received or is reversed (e.g., chargeback), APEX reserves the right to suspend delivery and/or cancel the order. Any costs incurred by APEX as a result of reversed payments may be charged to the Customer.

5. Shipping & Delivery

APEX ships all orders directly from the Netherlands via PostNL. Delivery times are estimates and are not guaranteed. Estimated delivery times are as follows:

Netherlands: 1–3 business days · EU: 3–7 business days · United Kingdom: 5–10 business days · Rest of World: 7–14 business days

Shipping Rates

Netherlands: €4.95 (free above €60) · EU: €6.95 (free above €60) · United Kingdom: €16.95 (free above €120) · Rest of World: €19.95 (free above €120)

International Orders

For deliveries outside the European Union, the Customer is responsible for any import duties, customs fees, and local taxes imposed by the destination country. APEX has no control over these charges and cannot predict their amount.

Risk of damage or loss of products transfers to the Customer upon delivery. If a shipment is lost or damaged during transit, please contact us at info@apex-wear.com within 7 days of the expected delivery date.

6. Right of Withdrawal & Returns

EU Right of Withdrawal

In accordance with EU Directive 2011/83/EU and Dutch law (Article 6:230o of the Dutch Civil Code), you have the right to withdraw from a distance purchase within 14 days of receiving the product, without giving any reason.

To exercise your right of withdrawal, you must inform APEX of your decision by email at info@apex-wear.com before the 14-day period expires. Please include your order number and the item(s) you wish to return.

Return Conditions

Returned products must be unused, unwashed, undamaged, and in their original packaging with all tags attached. Products that have been worn, washed, or altered will not be accepted for return.

Return shipping costs are the responsibility of the Customer, except in cases where the product is defective or the wrong item was delivered, in which case APEX will cover return shipping.

Refunds

Upon receipt and inspection of the returned item(s), APEX will process a refund to the original payment method within 5–7 business days. Please allow additional time for your bank or payment provider to process the credit.

Exceptions

The right of withdrawal does not apply to: products that have been made to the Customer's specifications (custom teamwear and collab orders), products that are clearly personalized, and products sold at a discount or marked as final sale.

7. Warranty & Conformity

All products sold by APEX comply with the agreement and meet reasonable expectations of quality and durability in accordance with Dutch consumer protection law (Article 7:17 of the Dutch Civil Code).

If you receive a product that is defective or does not conform to the agreement, please contact us at info@apex-wear.com within 2 business days of delivery, including photos or video of the defect and your order number.

APEX will, at its discretion, either replace the product, repair the defect, or issue a full refund including return shipping costs.

The warranty does not cover damage caused by improper use, failure to follow care instructions, normal wear and tear, or unauthorized alteration of the product.

8. Liability

APEX's liability is limited to the amount paid by the Customer for the specific product(s) giving rise to the claim. APEX shall not be liable for any indirect, incidental, special, or consequential damages.

APEX is not liable for damages resulting from improper use of products, failure to follow care instructions provided, or use of products for purposes other than their intended use.

APEX is not liable for delays or non-performance caused by circumstances beyond its reasonable control (force majeure), including but not limited to natural disasters, pandemics, strikes, supply chain disruptions, or governmental actions.

9. Privacy & Data Protection

APEX processes personal data in accordance with the General Data Protection Regulation (GDPR / AVG) and applicable Dutch data protection laws.

Personal data collected through orders (name, email, address, phone number) is used solely for the purpose of fulfilling your order, communicating about your order, and, if you have opted in, sending marketing communications.

APEX does not sell, rent, or share your personal data with third parties, except as necessary for order fulfillment (e.g., shipping carrier PostNL, payment service providers).

You have the right to access, rectify, or request deletion of your personal data at any time by contacting us at info@apex-wear.com.

10. Intellectual Property

All content on the APEX website — including but not limited to logos, designs, images, text, product designs, and brand elements — is the intellectual property of APEX Wear and is protected by Dutch and international copyright and trademark law.

No content from our website may be copied, reproduced, modified, distributed, or used for commercial purposes without prior written permission from APEX.

The APEX name, logo, and triforce icon are registered trademarks. Unauthorized use of these marks is strictly prohibited.

11. Custom Teamwear & Collab Orders

Custom teamwear and collaboration orders are made to the Customer's specifications. As such, the EU right of withdrawal (14-day cooling off period) does not apply to these orders, in accordance with Article 6:230p(f) of the Dutch Civil Code.

Custom orders require a separate quotation and written agreement between APEX and the Customer. Production begins only after the Customer has approved the final design and full payment has been received.

Delivery times for custom orders are estimated and communicated during the quotation process. Typical lead times are 4–6 weeks from design approval.

APEX guarantees the quality of custom products. If a custom order arrives with production defects or does not match the approved design, APEX will replace the defective items at no additional cost.

12. Applicable Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any dispute arising from or in connection with these Terms or any agreement shall be submitted to the competent court in Amsterdam, the Netherlands.

Before initiating any legal proceedings, we encourage you to contact us at info@apex-wear.com so we can try to resolve the matter amicably.

As an EU consumer, you also have the option to submit a complaint through the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
